Current Situation

Environment Court Appeal: 18 May 2009
Adjourned to 21st September 2009
The Environment Court Hearing into our (and others) Appeal against the Manukau CC decision to introduce the Plan Change for canal housing, started at last on May 18. With lawyers for ourselves, the ARC, Ngai Tai Umupuia, Ardmore Users Assn and some individuals all opposing the Plan Change plus those for the developers and Manukau CC supporting it, it was a pretty full Courtroom! So far the developers have presented their case and most of their experts have been cross-examined; and that is a far as we got in the two weeks. The Hearing is now adjourned until 21st September for a week with another week allocated in October. If it is not concluded then it will most likely go into next year.
This is a COUNCIL change to the District Plan – if it goes ahead the zoning of the land will be changed to allow for the development. This will mean a whole new settlement only 4.5km from Clevedon Village, potentially opening the door to a lot more development, and irreversible change to our rural Clevedon area.
Many thanks for supporting our events, the proceeds of which are all too rapidly swallowed up by experts and lawyers, who are necessary to put forward a good case to the Environment Court.
Clevedon Plan
We made a submission in person to the Manukau Council on the LTCCP (10 year plan) to reiterate the need to plan for Clevedon Village and Valley. We are hopeful that money will be allocated this time (but then we've said that before!), even if things are up in the air with the Super City.

Changes to the RMA
We had our 10 minutes at the Select Committee on the RMA Amendment Bill – more than some did! We expressed our concern with the suggested reduction in local individual and community group consultation, the introduction of security of costs and the changes to notification of Resource Management applications, and were thanked for a passionate submission – we’ll see what happens!

Bad News for Clevedon:
Manukau City Council gives go-ahead for canal
housing
We are furious and disappointed,
but not surprised, at the MCC decision to uphold
the Plan Change to allow canal housing on our
river at Clevedon. We will continue to fight against
this wholly inappropriate and ill conceived development.

Other local government submissions
Clevedon Cares presented evidence to the Hearing
for Local Government (Auckland) Amendment Act
2005 (LGAAA) and the Resource Management
Act 1991 ("RMA") of Changes to the Auckland
Regional Policy Statement and Plan Changes to
District Plans in the Auckland Region pursuant
to the Local Government (Auckland) Amendment Act
2005, generally opposing submissions which sought
to enable inappropriate urban development in the
rural area. The outcome of these Hearings are
expected in early 2007.

Council on the Proposed Plan Change closed on
24th May 2006.
Clevedon CARES delivered over 350 written submissions
to the Council, with a reminder that there is
a rural part of Manukau City!
The submissions were received by Leigh Auton,
Chief Executive Officer, and Brigitte de Ronde,
City Design & Planning Manager. We know that
there were a lot of other submissions sent directly
to Manukau City Council.

*The Draft Rural Strategy includes
the WRMV as though it is already an existing settlement,
around which further development could then occur,
and we opposed this presumption. The Draft Rural
Strategy interim decision changed the wording
from 'existing' to 'proposed' however the WRMV
is still a proposed development.
